TERMS OF USE FOR PLATFORM USERS

WELCOME TO THE BLOCK MANAGER PLATFORM

These terms explain our obligations as the provider of the Platform for use in relationship to the “Property” (as defined in the Service Agreement between the Freeholder or Client and Block Manager Technology Limited) and your obligations as a user of that Platform.

1. ABOUT THESE TERMS

1.1 Block Manager Technology Limited ("we" or "us") provides the Platform (referred to as “the Block Manager”) to support the management of your building.

1.2 By logging into and using the Platform, you (“you” or “your” being a director, officer, employee or shareholder of the freehold or leaseholder, resident or contractor for the Property) confirm that you have read and understood these terms and agree to be bound by them. If you do not agree to these terms, please do not use the Platform - you can still contact us by phone, WhatsApp, email or post.

1.3 If you fail to comply with these terms, we may suspend or terminate your access to the Platform.

1.4 We may update these terms from time to time. We will provide 30 days’ written notice before making any changes to these terms, which are subject to the Freeholder’s review and approval as set out in the Service Agreement.

2. WHAT YOU CAN USE THE PLATFORM FOR

2.1 We grant you the right to access and use the Platform. This right is:

  • For your personal use only (non-transferable)
  • Cannot be shared with others (non-sub-licensable)
  • Subject to your compliance with these terms

2.2 Your level of access to the Platform is based on your status (resident, leaseholder, shareholder, director, contractor, etc.).

2.3 You may use the Platform to:

  • View information about your building
  • Report and track issues and maintenance problems
  • Communicate with building management about property matters
  • Access building documents you’re entitled to see
  • Stay informed about building matters

2.4 You must only use the Platform for matters relating to the property. You must not use it for commercial purposes or any purpose unrelated to the building.

2.5 We may monitor and audit your use of the Platform to ensure compliance with these terms and maintain security.

3. KEEPING THE PLATFORM SAFE AND RESPECTFUL

3.1 You agree not to upload, access, store, distribute or transmit anything through the Platform that:

  • Is unlawful, harmful, threatening, defamatory, obscene, harassing or discriminatory
  • Contains sexually explicit images
  • Promotes unlawful violence
  • You know, or reasonably should know, contains viruses or other harmful software
  • Is intended to cause damage or injury to any person or property

3.2 You must not use the Platform for any illegal purpose.

4. WHAT YOU CANNOT DO WITH THE PLATFORM

4.1 To protect the Platform and other users, you must not (and must not attempt to, or allow others to):

  • De-compile, reverse engineer, or try to extract the source code of the Platform
  • Use the Platform to provide services to third parties or demonstrate services to others
  • License, sell, rent, lease, transfer, or distribute the Platform to anyone else
  • Try to obtain unauthorised access to the Platform or help others do so

5. YOUR ACCOUNT AND PASSWORD

5.1 To use the Platform, you will either register and create an account, or use an account created for you by us or the Freeholder.

5.2 Keep your login details (user ID, password, and any other security information) confidential. Do not share them with anyone else.

5.3 If you think someone else has accessed your account or there has been any security breach, you must:

  • Immediately notify us at: support@blockmanager.tech
  • Take any other steps we reasonably require to protect your account (such as changing your password)

6. PLATFORM AVAILABILITY

6.1 We do our best to keep the Platform running smoothly and available, but we cannot guarantee it will always be available or uninterrupted.

6.2 We may suspend, withdraw or restrict the Platform (or any part of it) for maintenance, security, or other business or operational reasons. We will try to give you notice where practicable.

6.3 We may also suspend your access to the Platform (without liability to you) if the contract between us and the Freeholder is paused or terminated.

6.4 If the Platform is unavailable, you can always contact us by:

6.5 These terms continue for as long as you use the Platform, which depends on the contract between us and the Freeholder.

7. YOUR PERSONAL INFORMATION AND PRIVACY

7.1 We take your privacy seriously. Our Privacy Notice (provided separately) explains:

  • What personal information we collect from you
  • How and why we collect, store, use and share it
  • Your rights in relation to your personal information

 

7.2 When you upload documents or information to the Platform, you are responsible for ensuring you have the right to share that information.

7.3 Different users see different information depending on their status (resident, leaseholder, shareholder, director, contractor, etc.). Your private documents remain private.

7.4 If you have questions about your personal information, please contact us or the Freeholder.

8. CONTENT YOU UPLOAD

8.1 When you upload documents or post information to the Platform:

  • You remain the owner of that content
  • You give us permission to store, process and display it as necessary for building management purposes
  • You confirm you have the right to share it and it doesn’t infringe anyone else’s rights

 

8.2 We are not responsible for content uploaded by users. However, we will remove inappropriate content if you report it to us at support@blockmanager.tech.

9. LINKS TO OTHER WEBSITES

9.1 The Platform may contain links to other websites or resources provided by third parties. These links are for your information only.

9.2 We do not control and are not responsible for the content of those websites or resources.

10. WHO OWNS THE PLATFORM

10.1 All intellectual property rights in the Platform belong to us (or our third-party licensors). This includes the software, design, technology, and other aspects of the Platform.

10.2 You own your documents and personal data - you can request to export them at any time.

11. OUR LIABILITY

11.1 We provide the Platform on an "as is" basis. While we make reasonable efforts to ensure it works properly, we cannot guarantee it will always be perfect, error-free, or available.

11.2 Our liability to you for any loss or damage arising from your use of the Platform is subject to the liability provisions in the Service Agreement between us and the Freeholder (Clauses 9.1-9.7).

11.3 Nothing in these terms excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

12. IMPORTANT LEGAL POINTS

12.1 These terms are between you and Block Manager Technology Limited (company number 16278794), whose registered office is 3 Orchard Place, London, SW1H 0BF.

12.2 These terms are governed by laws of England, and any disputes will be resolved in the courts of England.

12.3 If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

12.4 If we need to contact you about your use of the Platform, we will use the email address, mail or telephone you registered with.

12.5 We may only transfer our rights and obligations under these terms to another organisation with the written consent of the Freeholder.
